====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR ORAL ORDER 22-07-2026 Heard learned Counsel for the petitioner, learned APP for the State and learned counsel for the Mines Department.
2. The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 26 of 2026 registered for the offences under Sections 303(2), 317(2), 111(3) and 111(4) of the BNS 2023. Section 21 of the MM (D & R) Act and Sections 56 of the (CPIMT & s) Rule, which is pending in the Court of Learned Chief Judicial Magistrate, Gaya.
3. The prosecution story in brief, is that on 19.01.2026 at 5:30 A.M., the police received information about illegal mining at Falgu river in Dalechak village and the information being provided by Station House Officer of Belaganj Police
Patna High Court CR. MISC. No.49706 of 2026(2) dt.22-07-2026 2/3 Station. When Police reached at the place of occurrence, they saw 20-25 tractors doing illegal excavation. Taking the advantage of darkness, most of the tractors and persons fled away but, three tractors with trolley and one person was caught by the Police. The Police searched the tractors and 100 CFT sand was found on the three tractors. When the police examined the excavation site, 48120 CFT sand was missing and the estimated loss of the State is to the tune of Rs. 51,24,780/-.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The counsel further submits that the petitioner has four antecedents including the present case and on mere suspicion the petitioner' name was implicated in this case.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner and Learned counsel for Mines Department submits that huge revenue loss was occurred in respect to illegal excavation.
6. Having heard the parties and considering the fact that the petitioner was not arrested at the spot and his name was added to the list on suspicion, I am inclined to grant the petitioner benefit of anticipatory bail. Let the petitioner above named, in the event of arrest/surrender before the learned Court
Patna High Court CR. MISC. No.49706 of 2026(2) dt.22-07-2026 3/3 below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court is connection with Belaganj P.S.
