Petitioner, in the present case, is seeking regular bail in connection with Shikarpur P.S. Case No. 367/2020 registered for the offence under Section 341, 323, 498(A), 504/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. Learned Senior counsel for the petitioner submits that on a reading of the first information report it would appear that soon after the marriage took place between the parties a matrimonial discord has been noticed which led to the filing of the present F.I.R. No.5551 of 2021(2) dt.15-04-2021 2/3 engineer working with a reputed organization is in jail in connection with the present case since 21.10.2020, investigation against him is complete and he is now ready to enter into one time settlement with the opposite party no. 2 to amicably resolve the dispute. Mr. Sekhar Singh, learned counsel for the opposite party no. 2 has opposed the prayer for bail of the petitioner but ultimately learned counsel submits that opposite party no. 2 would be willing to go for one time settlement.

Learned A.P.P. for the State has also opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case wherein the present case has arisen on account of matrimonial discord soon after the marriage between the petitioner and opposite party no. 2, petitioner is an engineer working with a reputed organization and has remained in jail for almost six months and is also ready to enter into one time settlement with the opposite party no. 2, this Court directs release of the petitioner above-named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, in connection with Shikarpur P.S. Case No. 367/2020, subject to the condition as laid down under Section 437 (3) Cr.P.C. as under : (a) that such person shall attend in accordance with the

No.5551 of 2021(2) dt.15-04-2021 3/3 conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.

Further condition that the learned court below shall send the records of this case to the Mediation Centre attached to the court where both the parties shall sit together to amicably resolve their disputes and find out one time settlement within a time frame.

Let the records of this case be sent to the Mediation Centre by the learned court below within two weeks from the date of receipt/production of a copy of this order.
