JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Nirmali P.S.Case No. 34 of 2011 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 504, 379 of the Indian Penal Code.

Admittedly, after due investigation police submitted final form showing insufficient evidence in respect of petitioners but learned court below took cognizance of the offence against

Patna High Court Cr.Misc. No.30726 of 2014 (3) dt.05-02-2015 2/2 these petitioners also. Moreover, there appears to be no specific overt act attributed against these petitioners, except petitioner no. 3, who is said to be an order giver.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Birpur in Nirmali P.S.Case No. 34 of 2011, subject to condition as laid down under Section 438(2) of the Cr.P.C.
