JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in jail custody since 03-03-2013 on the accusation that one country-made automatic pistol was recovered from his conscious possession. Petitioner carries criminal antecedent of only one case.

Earlier prayer for bail was rejected by this court vide order dated 26-05-2014 passed in Cr. Misc. No. 13047 of 2014 with direction to the trial court to expedite the trial of the petitioner without giving unnecessary adjournments but learned counsel, appearing for petitioner drew my attention towards Annexure-4 to this petition and submits that uptill now, charge could not be framed against the petitioner.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kiul (Nawadah) Rail P.S. Case No. 14 of 2013 corresponding to Sessions Trial No.410 of 2013 to the satisfaction of learned Ad hoc Additional Sessions Judge-III, Lakhisarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
