JUSTICE ARUN KUMAR ORAL ORDER 06-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Triveniganj P.S.Case No. 407 of 2017 registered under Section 7 of the Essential Commodities Act.

Allegation in brief is that 120 bags of rice kept in bags bearing mark of S.F.C. were recovered and it is stated that petitioner was transporting the rice.

Submission is that suspicion is raised only because of the rice was found in the bags having print of S.F.C., but the petitioner is a retailer doing business of sale and purchase of rice and no licence is required under the Essential Commodities Act for trading rice and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Mahesh Kumar Bhagat @ Mahesh Bhagat,

Patna High Court Cr.Misc. No.19738 of 2018 (2) dt.06-04-2018 2/2 is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Supaul, in connection with Triveniganj P.S. Case No. 407 of 2017.
