2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 30 liters of foreign liquor was recovered from the spot kept in jute box .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of confessional statement of other co-accused persons who was apprehended on the spot. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner

Considering the fact that aforesaid facts and other circumstances of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Excise Court - 02 East Champaran Motihari in connection with Excise Chhauradano Mahuawa Police Station Case No. 428 of 2023 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
