1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 506 and 34 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 26.03.2024, the

No.49863 of 2026(2) dt.29-07-2026 2/3 accused persons including the petitioners assaulted her family members, further, Ranjeet Gupta (petitioner no. 1) and Ramsagar assaulted Nilesh by farsa causing injury while Rajan Gupta (petitioner no. 4) and Amit Gupta (petitioner no. 3) assaulted Jitendra by an iron rod causing injury on head and Rajesh Gupta (petitioner no. 5) along with Manish Gupta (petitioner no. 6) dragged the informant.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that during the course of investigation, police gave notice under Section 41(A) Cr.P.C. and the petitioners cooperated in the investigation and police never felt the need of arresting the petitioners and even submitted charge-sheet under bailable sections but then the learned Trial Court differing with the police report took cognizance under Section 307 I.P.C. also hence petitioners apprehend their arrest, it is next submitted that no doubt Nilesh suffered grievous injury but allegation of assaulting him is against petitioner no. 1 and Ramsagar as such the allegation of assault is not specific, it is also submitted that Ramsagar was taken in custody and has been released on bail, it is further submitted that since police during the course of investigation
Patna High Court CR. MISC. No.49863 of 2026(2) dt.29-07-2026 3/3 never felt need of arresting the petitioners whether it would be prudent for the Court to send the petitioners to jail based on an order of cognizance.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel appearing on behalf of the petitioners, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/Successor Court in connection with Guthani P.S. Case No. 70 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the B.N.S.S. (Satyavrat Verma, J) vikram/- U T
