JUSTICE BIRENDRA KUMAR ORAL ORDER 23-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR of the occurrence of murder is against unknown. The person who was present at the time of occurrence along with the deceased has also stated before the police that unknown person had fired.

Submission of the learned counsel for the petitioner is that the petitioner was apprehended by the police without any material against the petitioner and thereafter confessional statement of the petitioner has been recorded by the police and that is the only material against the petitioner who is in

Patna High Court Cr.Misc. No.10490 of 2018 (2) dt.23-02-2018 2/2 custody since 11.12.2017.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Derni Police Station Case No. 95 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
