The petitioner is in custody in connection with Nokha P.S. Case No. 97 of 2017, a case under Section 120(B) of the Indian Penal Code and Section 25 (1-B)a, 26 and 35 of Arms Act and later on police added Section 399, 402 IPC.
The petitioner has got no criminal antecedent and he is in custody since 16.10.2017.
Submission of learned counsel for the petitioner is that the police apprehended co-accused Mahavir Yadav on suspicion and from his possession fire arm and a blank cartridge was recovered and he has also disclosed the name of the petitioner as a person who had fled away from there. Investigation of the case is
Patna High Court Cr.Misc. No.11121 of 2018 (2) dt.27-02-2018 2/2 already complete now. Petitioner has got no criminal antecedent. Considering the nature and materials and other facts as discussed above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nokha Police Station Case No. 97 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
