JUSTICE ARUN KUMAR ORAL ORDER 31-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Desari PS (O.P. Sahadai) Case No. 220 of 2017 registered under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act. Learned Counsel for the petitioner submits that the allegation is that the petitioner and others were unloading country made liquor from the truck to car but neither the maruti vehicle nor the seized motorcycle is of the petitioner, only material against him is that he is said have been identified in the flash light of the head lamp of the jeep by the police officer, however, the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Kumar Choudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge (Excise) Vaishali at Hajipur in connection with Desari PS (O.P. Sahadai) Case No. 220 of 2017.
