In this case, the petitioner is seeking bail in connection with Palanwa P.S. Case No. 72 of 1998 registered for offences under sections 307, 324, 341/34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added Allegation has been made that dispute arose on account of harvesting the paddy, later on, the petitioner and his associates entered into the house of the informant and assaulted by various arms including Garasa was used that led to death of one person.
The counsel for the petitioner submits that as per the first information report, omnibus allegation has been made against
Patna High Court Cr.Misc. No.49231 of 2015 (2) dt.04-11-2015 2/2 all the persons, so much so that the petitioner is aged 81 years old, for that, he has annexed the photo copy of his identity card which was issued in the year 1995.
Only looking to the age of the present petitioner, this Court is granting bail to him, but is not taking into account the merit of the case.
The petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Raxaul at Mohari, East Champaran in connection with Palanwa P.S. Case No. 72 of 1998, Tr. No. 2531 of 2015.
