JUSTICE BIRENDRA KUMAR ORAL ORDER 07-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/149/323/307/302/379/447 of the Indian Penal Code.

The petitioner is in custody since 13.06.2016. Allegation against the petitioner and other co-accused is to have assaulted with lathi etc. to the deceased as a result whereof he died.

Submission is that co-accused Ujjawal Kumar Singh and Rupak Kumar Singh have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.4100 of 2015. Considering the aforesaid facts specially the

Patna High Court Cr.Misc. No.12967 of 2018 (2) dt.07-03-2018 P2/ period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Amnaur P.S. Case No.60 of 2014, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
