ANJANA MISHRA ORAL ORDER 10-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Forest Case No. 3-F of 2016 registered for the offences punishable under Sections 2/33/ of the Indian Forest Act 1927 (Bihar Amendment, 1990) and Sections 27/29/31 and 51 of the Wild Life Protection Act, 1927 (Amendment Act, 2006). Learned counsel for the petitioners submits that the allegation is that these petitioners were indulging in illegal Forest Act and had been carrying arms. It is further alleged that with the help of the torch light, the petitioners were identified. Learned

Patna High Court Cr.Misc. No.16660 of 2018 (2) dt.10-04-2018 counsel for the petitioners, however, submits that their names have come on mere suspicion and the petitioners have no criminal antecedent.

Having heard learned counsel for the petitioners and learned counsel appearing on behalf of the State and in view of the facts and circumstances of the case, let the petitioners abovenamed in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, West Champaran, Bettiah, in connection with Forest Case No. 3-F of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
