Petitioner is an accused in connection with Spl. Case No. 03/19, RC- 18A 17 arising out of Bhagalpur, Kotwali (Tilkamanjhi) P.S. Case No. 514 2017120(B) read with sections 409 and 420 of the Indian Penal Code and Section 13(2) read with Section 13(1) (C ) and (D) of the Prevention of Corruption Act, 1988.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that similarly situated accused persons have been granted bail by a co-ordinate Bench of this Court vide orders dated 17.08.2020, 08.09.2020 16.09.2020, 15.10.2020 and 19.10.2020 passed in Cr. Misc. Nos. 40816 of 2019, 21689
Patna High Court CR. MISC. No.3078 of 2021(3) dt.15-06-2021 2/2 of 2020 22914 of 2020, 20983 of 2020 and 26335 of 2020. It is further submitted that even the Hon'ble Supreme Court has also granted bail in Srijan Scam case of Pankaj Kumar in Cr. Appeal No. 484 of 2020 (SLP) (Cr.) No. 1530 of 2020. Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing personal bail bonds of Rs.
10,000/- (ten thousands) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge- XIV-cum Spl. Judge, CBI II, Patna in connection with Spl. Case No. 03 of 2019 arising out of RC-18/A/17.
