JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Maner PS Case No. 499 of 2017 registered under Sections 302 and 34 of the IPC. The allegation in brief is that son of the informant was last seen in the shop of Doman Sao in Village Gyaspur, thereafter he did not return back, later on his dead body was found in the village. The informant raised suspicion against the petitioner and others as they had given threatening one week prior to the said occurrence. Learned Counsel for the petitioner submits that merely on suspicion the petitioner has been implicated in this case, there is no other evidence against the petitioner, similarly situated another coaccused Salim Miya was admitted to bail by a coordinate Bench of this Court in Cr. Misc. No. 3751 of 2018 and the petitioner has got no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Ataul Mian @ Ataul Rehman @ Md. Shamim Ahmad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sandeep Kumar, Judicial Magistrate, lst Class, Danapur in connection with Maner PS Case No. 499 of 2017.
