JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Tilauthu P.S. Case No. 108/18, disclosing offences under Sections 30(a) and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Allegation is of recovery of 2735.28 litres of liquor from the boring room of the petitioner. Apart from that he is accused in two more cases of similar nature.
Submission of learned counsel for the petitioner is that there is nothing on record to show that the boring room from where the alleged recovery has been made belongs to petitioner and so far other cases are concerned, he is on bail in those cases.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and

No.46441 of 2019(2) dt.26-07-2019 2/2 circumstances as well as the fact that petitioner is an accused in two more case of similar nature, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record.
This application is, accordingly, dismissed.
