The petitioners are apprehending arrest in a case registered for the offences punishable under sections 272/273/34 of the Indian Penal Code and 47(a) of the Excise Act. 50 litres of illicit liquor were recovered when suspicion was raised against the petitioner.

It is submitted by learned counsel for the petitioner that admittedly recovery has not been made from the possession of the petitioner and only on suspicion petitioner has been roped in the present case. A statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.1469 of 2016 (2) dt.12-01-2016 2/2 petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Marhowrah P.S. Case No.349/2015, pending before the learned ACJM-II, Saran, Chapra.

With the above observation, this application is, accordingly, disposed off.
