The petitioners seek bail in a case instituted for the offences under Sections 302, 201, 120B and 34 of the Indian Penal Code. Heard learned counsel for the petitioners and learned APP for the State.

Allegation against the accused persons is of committing torture and thereafter caused death of the victim due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 23.2.2019 and have got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.48043 of 2019(2) dt.02-08-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners are in-laws of the deceased. They are separate in mess and property from the family of the deceased. They are residing at Kolkata. They have got no concern with the alleged occurrence. The name of the petitioners have transpired on the basis of suspicion. Except for suspicion, there is no other substantive evidence to suggest their implication in the present case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Vaishali at Hajipur in connection with Goraul P.S. Case No. 80 of 2019.
