The petitioner, who is in custody, seeks bail in connection with Bhawanipur (Balia) P.S. Case No. 180 of 2017 registered for the offence punishable under Sections 457, 380 and 411 of the Indian Penal Code.

Informant has stated that on 08.07.2017 at about 2:00 AM in the night he was sleeping with his family and was awaken because of some noise of villagers that one thief has entered into his house and thereafter he was caught by villagers and handed over to the police. From the motorcycle of petitioner Rs. 13,000/- cash and one silver payal and some gold articles has been recovered.

No.15563 of 2018(3) dt.13-04-2018 2/2 It has been submitted on behalf of the petitioner that he has been falsely implicated in this case due to village politics and he was not arrested from the place of occurrence. No incriminating material has been recovered from his conscious possession. It has been further submitted that petitioner is in custody since 07.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Purnea, in connection with Bhawanipur (Balia) P.S.
