JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel, appearing for the informant.
The informant is not an eye witness of the alleged occurrence and it appears that the name of petitioner and other accused came in the oral dying declaration of deceased as the informant claims that having heard the sound of firing, he came at the place of occurrence and found the deceased in pool of blood and thereafter, while the deceased was being taken to hospital, the deceased disclosed the name of petitioner and some others. It is stated in the first information report that one field man who appears to be petitioner, was caught by the villagers after the occurrence but admittedly, no fire-arm was recovered from
Patna High Court Cr.Misc. No.19878 of 2015 (3) dt.01-10-2015 2/2 possession of the petitioner. Moreover, having more or less similar allegation, one co-accused namely, Dharmendra Bind has already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chainpur P.S. Case No. 29 of 2015 to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua.
