Petitioners seek bail in a case registered for the offence punishable under Sections 397 of the Indian Penal Code. The FIR of the occurrence of Dacoity is against unknown. On the basis of information of Spy, the petitioners were arrested.

Learned counsel for the petitioners submit that they are innocent and have been falsely implicated in this case on mere suspicion only. Nothing has been recovered from the possession of the petitioners. The name of the petitioners has surfaced in

Patna High Court CR. MISC. No.5858 of 2021(4) dt.15-07-2021 2/3 this case on the basis of confessional statement of co-accused Abhishek Mehta who has already been granted bail by a cooridinate bench of this Court vide order dated 05.07.2021 in Criminal Miscellaneous No. 12724 of 2021. Petitioners have not been put on TIP till date. Chargesheet has already been submitted in this case. Petitioners are in custody since 23.07.2020.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Karjain P.S. Case No. 75 of 2020, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the court below.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case,
