The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420, 120(B), 504 of the Indian Penal Code.

The prosecution case as per F.I.R is that the F.I.R named accused persons opened an Institution in the name of Central Bank Employee Savings & Credit Self Supported Co-operative Society Limited, Supaul with its branch at Saharsa and started schemes like daily deposit etc. The informant opened a recurring account in

Patna High Court CR. MISC. No.62077 of 2021(3) dt.05-07-2022 2/3 the said Institution and deposit Rs. 1,37,700/-. It is alleged that when the informant demanded the maturity amount, the accused persons refused to make any payment to him.

It is submitted by learned counsel for the petitioner that petitioner was only an employee holding the post of Office Superintendent in the said Institution and he had no role in the policy matter of the Institution. In fact, not a single penny was misappropriated by any one. Even the matter was heard before this Hon'ble Court and this Hon'ble Court had directed to appoint an Office Liquidator to settle the dues of the complainants/depositors and in pursuance to the Court's order, the Collector, Supaul was appointed as Official Liquidator and he requested all the District & Sessions Judges of judgeship of Saharsa, Supaul, Madhepura, Begusarai and Purnea to not accept any further complaints made in this regard and the complaints made earlier were also requested to be transferred before him

Patna High Court CR. MISC. No.62077 of 2021(3) dt.05-07-2022 3/3 for payment of the deposits made by the depositors. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 2286 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
