Petitioner along with his wife had executed a sale deed relating to a land, which was under hypothecation to the Syndicate Bank on account of loan borrowed by petitioner and his wife.

Petitioner's wife Veena Sharma has been granted anticipatory bail vide order dated 05.08.2015 under Criminal Miscellaneous No.31058 of 2015 wherein petitioner also stood as one of the applicants, however, due to his arrest became infructuous to his extent. While granting provisional bail, a condition has been imposed regarding repayment of loan amount which, till today, has not been paid as is evident from the

Patna High Court Cr.Misc. No.48958 of 2015 (02) dt.04-11-2015 disclosure made in the petition.

However, taking into account the totality of the event, petitioner Kumod Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P. S. Case no.431 of 2014, only after payment of the loan amount along with interest to the Syndicate Bank. (Aditya Kumar Trivedi, J) Vikash/- U T
