The present writ application has been filed for a direction to the respondent authorities to restore possession of the house of the petitioner in its original position since it has been demolished in pursuance to the final order passed in Encroachment Case No. 1 of 2016-17 by the respondent no. 8, Circle Officer, Gogri. Prayer has also been made to compensate the petitioner by making payment of Rupees Twenty Five Lacs. However, learned counsel for the petitioner seeks permission to withdraw this writ application to file appeal under section 11 of the Bihar Public Land Encroachment Act against the final order passed in Encroachment Case No. 1 of 2016-17. It is expected from the appellate authority to consider the application of the petitioner for condonation of delay in filing such appeal in view of the fact that the petitioner was
