The petitioner apprehends his arrest in connection with Itadhi P.S. Case No. 237 of 2017 registered under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The informant, an ASI, on information that illicit liquor was being sold in village Purushottampur, went there but the petitioner is said to have fled away from the village and some quantity of liquor was recovered.
Learned counsel for the petitioner submits that petitioner was not apprehended on spot. Due to village politics, Chaukidar named the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no

Considering the facts and circumstances, let the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with Itadhi P.S. Case No. 237 of 2017 to the satisfaction of the learned Additional District Judge-II-cumSpecial Judge, Excise Act, Buxar or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
