This is an application for anticipatory bail for the offence punishable under section 366 (A) of the I.P.C. Allegedly the petitioner kidnapped 15 years old minor daughter of the informant.

Submission is that the petitioner and the victim girl both have arranged marriage and both are living happily to which the learned A.P.P. opposes by submitting that the victim girl is still traceless as is evident from the case diary.

Considering that the victim girl is still traceless and allegedly the petitioner kidnapped the minor daughter of the informant and as such this Court is not persuaded to grant pre-arrest bail to the petitioner. Accordingly, such prayer of the petitioner is rejected in connection with Pirpainti P.S. Case No. 155 of 2012 pending in the court of C.J.M. Bhagalpur.
