2. The petitioners have preferred this application for grant of regular bail in connection with Pipra P.S. Case No. 157 of 2022 dated 05.06.2022 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
3. As per the prosecution case, on 05.06.2022 at about 04:10 A.M., 8 to 10 unknown miscreants entered the house of the informant and committed loot of Rs. 1,50,000/- in cash and some other valuable articles on the point of pistol and fled away from there.
4. Learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.50492 of 2025(2) dt.15-10-2025 2/3 that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the FIR. The name of the petitioners has surfaced in this case during the course of investigation. No T.I.P. has been conducted by the prosecution. Nothing has been recovered from the possession of the petitioners. The petitioners have no concern with the alleged offence. The co-accused person has already been granted regular bail by this court vide order dated 07.05.2025 passed in Cr. Misc. No. 26061/2025. The petitioners have 14 criminal antecedents in which he is not in bail in eight cases as stated in para 3 of the bail petition. The petitioners are in custody since 30.08.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Pipra P.S. Case No. 157 of 2022 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which
Patna High Court CR. MISC. No.50492 of 2025(2) dt.15-10-2025 3/3 on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
