The petitioners, in the present case, are seeking regular bail in connection with Beldour P.S. Case No.36 of 2017, arising out of G.R.No.489 of 2017 and Special Case No.2 of 2017, registered for offences alleged under Sections 17 and 18 of the N.D.P.S. Act.
Learned counsel for the petitioners submits that the allegation against the petitioners is that 20 plants of opium were found in the land belonging to these petitioners. Submission of the learned counsel for the petitioners is that the land of these petitioners was taken on lease by co-accused Prem Chandra Mistri
Patna High Court Cr.Misc. No.5018 of 2018 (2) dt.02-02-2018 who has been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.20774 of 2017. Learned counsel further submits that the petitioners have no criminal antecedent. Learned counsel for the State is present.
Considering the facts and circumstances particularly that the petitioners have no criminal antecedent, let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria in connection with Beldour P.S. Case No.36 of 2017, arising out of G.R.No.489/17 and Special Case No.2 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
