The petitioner has filed the instant application for grant of regular bail in connection with Hathauri P.S. Case no. 171 of 2019 registered under sections 304B and 34 of the Indian Penal Code. As per allegation in the FIR, the accused persons including the petitioner herein are stated to have tortured the daughter of the informant for non-fulfillment of demand of dowry and ultimately to have killed her.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. The petitioner is father-in-law of the deceased. The relation between the victim and her husband were amicable and they had two sons from the wedlock. The petitioner was living separately from them. As per
Patna High Court CR. MISC. No.5327 of 2021(3) dt.22-06-2021 2/2 the knowledge of the petitioner, the daughter of the informant committed suicide. The petitioner is in custody since 12.9.2020 and has no criminal antecedent.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and on going through the records of the case it transpires that the husband of the deceased is in custody.
Taking into consideration the facts and circumstances of the case, the petitioner being the father-in-law of the deceased who has remained in custody for over nine months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Hathauri P.S. Case No. 171 of 2019 (Trial No. 3391 of 2019) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Muzaffarpur.
