The petitioner seeks bail in a case registered for offences punishable under Sections 302 and 120B of the Indian Penal Code. It is submitted that the petitioner is not named in first information report but as per allegation his father-in-law, namely, Bachchu Rai had threatened the deceased of dire consequences and allegation is that the aforesaid Bachchu Rai and this petitioner had hired criminal for killing the deceased. However the basis of such allegation is confessional statement of the accused persons. It is contended that one of the named accused, namely, Bachchu Rai had already been granted bail by order dated 29.9.2015 passed in
Patna High Court Cr.Misc. No.50197 of 2015 (2) dt.10-11-2015 2/2 Cr. Misc. No. 45145/2015.
Having regards to the facts and circumstances of the case, the petitioner, namely, Shyam Kumar @ Nanhe is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sadar, East Champaran, Motihari in Pakaridayal P.S. Case No. 96/2015.
