JUSTICE BIRENDRA KUMAR ORAL ORDER 26-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 364A/34 of the Indian Penal Code.

On recovery, statement of the victim of abduction was recorded under Section 164 Cr.P.C. wherein he does not claim to have identified the petitioner as one of the culprit. However, the name of the petitioner has surfaced on the confessional statement of co-accused. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.16735 of 2018 (2) dt.26-03-2018 P2/ Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chhauradano P.S. Case No. 222 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
