JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 385, 387, 326, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that the F.I.R named accused persons resorted to fire at the residence of the widow daughter of the informant. On enquiry being made, petitioner No. 1 asked the informant to get the extortion payment of Rs. 5,00,000/- made. On protest being made, it is alleged that Satyam Kumar @ Murari resorted to fire which hit on the right leg of the informant.
It is submitted by learned counsel for the petitioners that petitioners are neighbour of the informant and maliciously the accusation has been levelled. The accusation is not specific against the petitioners. The specific accusation is
Patna High Court Cr.Misc. No.47921 of 2015 (2) dt.04-11-2015 2/2 against Satyam Kumar @ Murari who is not petitioner before this Court. Moreover the informant has admitted that there is land dispute between the parties from before. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Matihani P.S. Case No. 116 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
