The petitioner seeks bail in connection with Kudhani P.S. Case No. 550 of 2021, dated 27.07.2021, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

21.00 litres of liquor is said to have been recovered from a bank of river, which is said to be belong to the petitioner.

Patna High Court CR. MISC. No.59919 of 2021(2) dt.23-05-2022 2/2 It has been submitted on behalf of the petitioner that such accusation does not have any foundation as the recovery is from an open place and the petitioner does not have criminal antecedents.

The petitioner is said to be in custody since 27.08.2021.

Regard being had to the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhani P.S. Case No. 550 of 2021.

The application stands allowed.
