The petitioners apprehend arrest in connection with Derni Police Station (PS) case No 35 of 2006 arising out of Complaint Case No 1891 of 2006 in which final form was submitted but upon protest petition which has now numbered as Complaint Case No 2806 of 2010 cognizance having been taken by the Chief Judicial Magistrate (CJM), Saran at Chapra, inter alia, under Section 304 of Indian Penal Code, learned counsel for
Patna High Court Cr.Misc. No.30083 of 2014 (2) dt.14-01-2015 the petitioners points out that there are case and counter case. Petitioners' version is that they are shopkeepers and the deceased was trying to demand money and loot them on which villagers crushed him as a consequence of which he died. The informant is the father of deceased.
Be that as it may, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Saran at Chapra in Derni PS Case No 35 of 2006 arising out of Complaint Cases No 1891 of 2006 and 2806 of 2010/UT No 224 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
