JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 22.11.2017, seeks bail in Tedhagachh PS Case No. 78 of 2017 registered under Sections 379, 411, 467, 468, 471, 420 and 120 of the IPC.
The allegation in brief is that motorcycle of the informant was stolen from the market place but the said motorcycle was recovered from the possession of the petitioner and during investigation registration number and chassis number were found tampered.
Learned Counsel for the petitioner submits is that the petitioner purchased the motorcycle from one Ibrahim and he has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Shah Salauddin @ Sha Salauddin is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kishanganj in connection with Tedhagachh PS Case No. 78 of 2017.
