JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.1.2018, seeks bail in Chapra Muffasil PS Case No. 374 of 2017 registered under Sections 379 of the IPC.

The allegation in brief is that a motorcycle was stolen by some unknown accused persons and later on during enquiry the petitioner and others were apprehended with the stolen motorcycle. Learned Counsel for the petitioner submits that the petitioner had taken lift on the said motorcycle and while on the way he was apprehended.

Whereas learned Counsel for the State submits that the petitioner was apprehended with the stolen motorcycle and he has also one criminal antecedent of similar nature. Having considered the said facts and circumstances, presently the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of six months and if it is not concluded the petitioner may renew his prayer for bail.
