JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Tandwa P.S. Case No. 30 of 2013 registered for the offences punishable under Sections 147, 148, 323, 307, 436, 427, 504 and 379 of the Indian Penal Code.

It is submitted that in this case altogether 13 accused persons have been allowed pre-arrest bail vide order dated 28.4.2014 passed in Cr. Misc. No. 7004 of 2014 and the case of the petitioner being similar deserves sympathetic consideration. It is further submitted that against the petitioner there is allegation of committing assault by tangi but no such injury has been found to which the learned APP fairly concedes.

Patna High Court Cr.Misc. No.30119 of 2014 (2) dt.19-01-2015 Considering the nature of allegation and genesis of the occurrence, the petitioner above named, in case of surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Tandwa P.S. Case No. 30 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
