JUSTICE RAJIV ROY ORAL ORDER 22-06-2023 Heard the learned counsel for the petitioner, State as also the Respondent Nos. 1 &2 (private respondents). The petitioner has come before this Court with a prayer to direct the respondent no. 5, the Executive Officer, Nagar Panchayat Hisua, Nawada to act in accordance with the direction given by the Collector, Nawada on 24.03.2017 (Annexure-7).

It is unfortunate that even for implementation of an

Patna High Court CWJC No.14971 of 2017(5) dt.22-06-2023 2/2 order of the Collector, Nawada, the petitioner has to move before this Court and the matter remains pending for six years, if the submission of the learned counsel for the petitioner is to be believed.

The respondent no. 5, the Executive, Nagar Panchayat Hisua, Nawada has to act in accordance with the direction given by the Collector, Nawada, if still not done. The writ petition, accordingly stands disposed of with a direction to the respondent no. 5 to immediately act on the direction dated 24.03.2017 passed by the Court of District Collector-cum-Second Appellate Authority, Nawada Let a copy of this order be served upon the Collector, Nawada for his perusal and necessary action as it is his order which according to the petitioner has not been taken note of by the respondent no. 5.

The writ petition stands disposed of with aforesaid observation.
