In this application for anticipatory bail the petitioner apprehends his arrest in a case for the offence punishable under sections 147, 148, 149, 323, 324, 307, 452, 380, 504 and 427 of the I.P.C.

Allegedly, the petitioner and others F.I.R. named accused persons and 8-10 unknown being armed with Lathi, Danda, Farsa, Bhala and Sword attacked on the Barat party resulting some of the members of Barat party became injured and further they snatched all the ornaments from the Barat party and damaged the vehicle also.

Submission is of false implication by submitting that due to village politics name of the petitioner has been implicated.

Patna High Court Cr.Misc. No.30164 of 2014 (2) dt.20-01-2015 2/2 One Amit Kumar was assaulted by the informant's side and he has also lodged Baniapur P.S. Case No. 128 of 2013 and only to save the skin the present case has been filed by the informant. The allegations are general and omnibus and no specific allegation and allegation of theft is super addition to make the case serious and no case under section 307 I.P.C. is made out. It is submitted that the petitioner has been selected for appointment in the Railway Department and he is likely to join recently, as submitted.

In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saran at Chapra in Baniapur P.S. Case No. 113 of 2013, subject to the conditions as laid down in section 438
