Petitioner is in custody in connection with Karja P.S. Case No. 192 of 2018 for the offence under sections 341, 323, 324, 504, 506/34 of the Indian Penal Code and later on Section 307 of the Indian Penal Code was added.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and there is delay of two days in lodging the FIR.

Learned counsel submits that from the injury report, it transpires that the injury was caused by hard blunt substance whereas the allegation is that the petitioner has used Farsa. Learned counsel for the petitioner submits that petitioner is in custody since 12.6.2019.

No.48942 of 2019(3) dt.27-09-2019 2/2 Considering the fact that petitioner has no criminal antecedent and the nature of injury is not attributed to the petitioner as the injury was found to be caused by hard blunt substance whereas the allegation against this petitioner is that he has fused Farsa, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II,West Muzaffarpur, in connection with Karja P.S. Case No. 192 of 2018.
