This application for grant of regular bail arises out of Rajepur P.S. Case No. 22 of 2015, disclosing offences under Section 414 of the Indian Penal Code and Sections 25 (a-b) a, 26 of the Arms Act and Section 17 of C.L.A. Act. From the petitioner's possession, one country-made loaded pistol and a live cartridge were recovered. He is in custody in connection with the present Rajepur P.S. Case No. 22 of 2015 since 08.03.2015.
Learned counsel for the petitioner submits that since chargesheet has been submitted and the investigation is complete,
Patna High Court Cr.Misc. No.47379 of 2015 (2) dt.10-11-2015 2/2 custodial interrogation of the petitioner is not required any more and, therefore, no purpose would be served if the petitioner is allow to languish in jail any further.
Considering the submission as above, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Motihari, District East Champaran in connection with Rajepur P.S. Case No. 22 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
