The petitioner seeks pre-arrest bail in connection with Kishanpur P.S. Case No.148 of 2014 registered under Section 366A of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act.
It is contended that the petitioner is a juvenile and her date of birth is 14th July, 1999. In case, the petitioner is a juvenile, her application under section 438 of the Code of Criminal Procedure is not maintainable.
In that view of the matter, the application is disposed of as not maintainable.
