JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.7.2017, seeks bail in Kusheshwar Asthan (Tilkeshwar O.P.) PS Case No. 136 of 2017 (S.T. No. 515 of 2017) registered under Sections 302, 201, 34 of the IPC.

The allegation in brief is that two dead bodies were found thrown after committing murder and it transpired during investigation that one of the deceased was having illicit relationship with one Rupa Devi.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, there is no other material except confessional statement of the petitioner and Rupa Devi. It is further submitted that Rupa Devi is a married lady and the petitioner is not her husband, Rupa has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 5946 of 2018 and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Shivji Mukhia is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
