2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Ghanshyampur P.S. Case no. 68 of 2026 instituted for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109(1), 303(2), 352 of the Bharatiya Nyaya Sanhita.
3. The prosecution case, in brief, is that the informant received information on his mobile phone regarding a scuffle that had taken place in his village. Upon

No.49458 of 2026(2) dt.22-07-2026 2/3 reaching the place of occurrence, he allegedly found the petitioners, along with several co-accused persons, assaulting his family members, namely, Arvind Mukhiya, Rohit Mukhiya, and Dhanveer Yadav, by means of lathis, dandas, iron rods, bricks, and stones. It is specifically alleged that petitioner No. 1 assaulted Dhanveer Yadav with an iron rod, causing head injuries; petitioner No. 2 assaulted Arvind Mukhiya with an axe, causing head injuries; and petitioner No. 3 assaulted Raju Mukhiya with bricks, also causing head injuries. It is further alleged that the accused persons snatched gold ornaments from Dhanveer Yadav and Raj Kumar Mukhiya.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case in the background of personal grudge and village politics. The present case is a counter blast of Ghansyampur P.S. Case No. 67 of 2026. It is further submitted that injury sustained by the injured persons are simple in nature, as opined by the doctor. A statement has been made in Para 3 of the bail application that petitioners

5. Learned APP for the State has vehemently opposed the prayer of anticipatory bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Ghanshyampur P.S. Case no. 68 of 2026, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Biraul, Darbhanga subject to the conditions as laid down under section 482(2) of the BNSS.
