JUSTICE SUDHIR SINGH ORAL ORDER 26-07-2017 Learned counsel for the petitioner seeks permission to withdraw the present writ application with a liberty to prefer an appeal before the State Appellate Authority, challenging the order dated 27.04.2011, passed in Appeal Case No. 58/2009 by the Member, District Teachers Employment Appellate Authority, Madhepura, and order contained in Letter No. 102 dated 18.08.2011 passed by the District Programme Officer

Patna High Court CWJC No.21157 of 2011 (4) dt.26-07-2017 2/2 (Establishment), Madhepura.

Permission is accorded.

The petitioner shall file an appeal before the State Appellate Authority within a period of thirty days from the date of the order, which shall be disposed of in accordance with law within the statutory period.

It has been submitted by learned counsel for the petitioner that the case of the petitioner is covered by a judgment passed by this Court in C.W.J.C No. 15726 of 2011 (Savitri Kumari Vs. The Panchayat Secretary and Ors.) dated 09.05.2017 and further by the order passed in L.P.A. No. 706 of 2012 (Akhilesh Kumar Mehra Vs. The State of Bihar & Ors.) dated 10.02.2014. The State Appellate Authority will examine, whether the case of the petitioner is covered by the aforesaid judgment and order passed in the aforesaid two cases.

With the aforesaid observations and directions, the present writ application stands disposed of.
