The petitioner seeks modification of the order dated 2.12.2015, passed in Cr. Misc. No. 52204 of 2015 by which the petitioner was directed to deposit the first installments of Rs. one lac within a period of one month from the date of the order. It has been submitted by the learned counsel for the petitioner that the petitioner could not deposit the first installment of Rs. one lac within time as he met with an accident. The modification application is allowed to the extent indicated below. The petitioner will now deposit Rs. one lac as first installment within a week from the receipt of this order and rest two installments will be deposited as per the schedule fixed by the

Patna High Court Cr.Misc. No.1749 of 2016 (2) dt.13-01-2016 2/2 order dated 02.12.2015 passed in Cr. Misc. No. 52204 of 2015. On deposit of first installment and in the event of his arrest or surrender before the Court below within a period of four weeks from today the above named petitioner shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S.Case No. 89 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P. C. The modification of the order dated 02.12.2015 is allowed only to the extent as indicated above.
