The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 180 of 2020 registered under Sections 272, 273 of the I.P.C. and section 30(a) of the Bihar Prohibition and Excise Act pending in the Court of Special Judge, Excise Act, Muzaffarpur.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Further submission is that petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. Further, he

Patna High Court CR. MISC. No. 3177 of 2021(2) dt.15-11-2021 2/2 contended that the alleged recovery of foreign liquor has been made from Dalan of the petitioner. Hence, this is not a fit case for anticipatory bail.

Having considered the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) shailendra/- U T
