JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and State. The petitioner apprehends his arrest in a case under section 47(a) of the Excise Act.

It is alleged that the petitioner was carrying 40 litres of country made liquor on his motorcycle. On being chased, he fled away, after leaving away his motorcycle.

The petitioner submits that he has no criminal antecedent. He further submits that the country made liquor was found near the flank of nearby canal.

Having regard to the facts and circumstances of the case, the petitioner, namely, Nain Singh is directed to be released on

No.49261 of 2015 (3) dt.15-12-2015 anticipatory bail, in the event of his arrest/surrender, on furnishing a bail bonds of Rs. 5000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in Excise Case No. 16 of 2015 subject to the condition that one of the bailers would be his father. Besides this, his father would accompany him in the Court at least once in every three dates.
