JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 23.12.2017, seeks bail in connection with Spl. Case No. 31 of 2018 arising out of Bypass P.S.Case No. 195 of 2017 registered under Sections 354, 354B, 354A and 509/34 of the Indian penal Code and 12 of Protection of Children from Sexual Offence Act. Allegation in brief is that petitioner used to outrage the modesty of the informant while on the way to her school for last 15 days and when protest was made to petitioner's family members, they also assaulted.
Submission is that petitioner is neighbour and has falsely been implicated in this case and has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Lal Bihari, is directed to be released on
Patna High Court Cr.Misc. No.19479 of 2018 (2) dt.05-04-2018 2/2 bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge Patna, 1st cum Spl. Judge, POCSO, Patna in connection with Spl. Case No. 31 of 2018 arising out of Bypass P.S. Case No. 195 of 2017 with condition that if he is found involved in similar type of offence, his bail bond shall be liable to be cancelled.
