JUSTICE PARTHA SARTHY ORAL ORDER 26-03-2021 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with K. Hat (Sahayak) P.S. Case no. 554 of 2020 registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

As per allegation in the FIR, 52 litres of IMFL is stated to have been recovered from the tempo in which petitioner was also traveling.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the person or possession of the petitioner. He has no concern with the alleged tempo in question nor with the seized liquor. He is in custody

Patna High Court CR. MISC. No.5237 of 2021(2) dt.26-03-2021 2/2 since 10.10.2020. Chargesheet has been submitted in the case and he has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and in the facts and circumstances of the case including the petitioner not having any criminal antecedent and chargesheet having been submitted in the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with K. Hat (Sahayak) P.S. Case no. 554 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Purnea.
